MaxxedAI - Terms and Conditions

Welcome to MaxxedAI! These Terms and Conditions govern your use of the MaxxedAI mobile application ("App"), owned and operated by Maxxed Inc. ("Company," "we," "us," or "our"). By accessing or using MaxxedAI, you agree to these terms. If you do not agree, please do not use the App.

1. Eligibility

• You must be at least 17 years old to use MaxxedAI.
• If you are under 18, you confirm that your parent or guardian consents to your use of the App.
• By using MaxxedAI, you confirm that you have the legal capacity to agree to these terms.

2. Subscriptions & Billing

Subscription Tiers

MaxxedAI offers three subscription plans:

• Basic – Limited access with free tokens.
• Gold – Enhanced features and more tokens.
• Premium – Full access with the highest token allocation.

Billing & Auto-Renewal

• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing cycle.
• Payments are processed through RevenueCat via the Apple App Store.
• You can manage or cancel your subscription in your App Store settings.

Refund Policy

• All in-app purchases are final. Refunds are subject to Apple’s refund policies.
• We do not issue refunds for unused tokens or partial subscription periods.

3. Token Purchases & Usage

• Tokens can be purchased through in-app purchases.
• Tokens are non-refundable and non-transferable.

4. User-Generated Content

• By uploading photos, you grant us a license to process them for AI analysis.
• You confirm that you own the rights to any uploaded content.
• You may not upload images containing minors or third parties without consent.
• We reserve the right to delete any user's account for any reason

5. Account Termination

• We reserve the right to suspend or terminate accounts for violations of these terms.
• Users may delete their accounts at any time through the App.

6. Acceptable Use

• You must not use MaxxedAI for unlawful purposes, harassment, or exploitation.
• Any misuse may result in immediate account termination.

7. Intellectual Property

• MaxxedAI and all its content are owned by Maxxed Inc. and protected by copyright laws.
• You may not copy, distribute, or modify any part of the App without our permission.

8. Liability Disclaimer

• MaxxedAI provides AI-generated results for informational purposes only.
• We do not guarantee the accuracy or completeness of facial analysis results.
• We are not liable for any emotional distress or decisions made based on MaxxedAI's output.

9. Dispute Resolution

• Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA) as applicable in the State of California.
• Users waive the right to a class action lawsuit.
